Refer-a-Friend Programme

Participation in this Amazon Flex delivery partner Referral Programme ("Programme") is subject to these Terms and Conditions (these “Programme Terms and Conditions”) and the terms and conditions in your Amazon Flex Independent Contractor Terms of Service (the “Amazon Flex Terms”), which are incorporated herein (collectively, the “Programme Terms”).

Please read these Programme Terms carefully. By accessing or participating in the Programme, you agree to be bound by the Programme Terms and all terms incorporated herein by reference, including terms regarding dispute resolution. If you do not agree to the Programme Terms, do not access or participate in the Programme.

‍Referrer Eligibility

‍An eligible “Referrer” is an Amazon Flex delivery partner who has directly received an official Programme invitation email from Amazon Flex. Eligible Referrers may participate in the Programme by referring one or more new individuals to Amazon Flex. The maximum number of Referral Incentives which an eligible Referrer may be entitled to during the Referral Period is specified in the invitation email. When you refer the Referee, you represent and warrant to us that you have obtained their prior consent to transmit electronic communication(s) containing the referral link to those individuals. Additional referral limitations and specific Programme Terms (including requirements to receive a Referral Incentive, defined below) will be detailed in the official Programme invitation email.

‍Referee Eligibility

‍A “Referee” means an individual who is referred to Amazon Flex through this Programme by a Referrer within the Referral Period. To qualify as a Referee, the individual (1) must be a first-time Amazon Flex delivery partner applicant with no previous Amazon Flex account or registration history, (2) must meet the eligibility criteria set by Amazon Flex for Referees from time to time including in respect of vehicle type, (3) must complete the Amazon Flex registration exclusively through the authorized referral link provided by an eligible Referrer, and (4) must use the same email address used to sign up for the referral programme when creating your Amazon Flex account.

‍Referral Incentive Amazon.sg e-gift Card

‍A “Referral Incentive” means the Amazon.com.sg e-gift card issued to qualifying Referrers and Referees upon successful completion of the referral requirements. The incentive value will be specified in each campaign communication (e.g., email, in-app notification) and may vary by campaign. Please refer to the specific campaign conditions provided at the time of participation for the applicable incentive amount and eligibility criteria. The e-gift card will be valid until the expiry date stated on the e-gift card. The e-gift card may only be used in accordance with the e-gift card terms and conditions available at https://flex.amazon.com.sg/promos/terms-and-conditions/refer-a-friend and you agree to be bound by such terms and conditions. Amazon will not be liable for any e-gift card that has been stolen, forged, lost, damaged or tampered with in any way. Amazon reserves the right to amend the Referral Incentive prior to the commencement of any Referral Period.

To qualify for the Referral Incentive, the eligible Referee must complete a specific number of delivery blocks within the specified timeframe outlined in the Programme invitation email to the Referrer.

The Referral Incentive will become available to both the Referee and the associated Referrer via the referral dashboard within thirty (30) business days of qualifying criteria completion and must be redeemed through the same referral dashboard. After the Referral Incentive is distributed, both the Referrer and the Referee will receive a confirmation email notifying them about the availability of the Amazon.com.sg e-gift Card in the referral dashboard. Amazon shall not be liable for, and you shall not be entitled to receive, any Referral Incentive for Referees referred through improperly formatted referral links.

Eligibility for Referral Incentives is limited to the original Referrer who received the programme invitation and their directly referred Referee(s), subject to meeting all applicable eligibility criteria, including vehicle type. Redistribution of referral links by parties other than the original Referrer is prohibited, and no Referral Incentives shall be awarded for sign-ups resulting from such redistribution. Amazon reserves the right to revoke the Referral Incentive if Amazon believes, in its sole discretion, acting reasonably, that the Programme participation was earned through or in connection with any fraud, abuse of the Amazon Flex app, or in violation of these Programme Terms.

‍Referral Period

‍The referral window will be open for eligible Amazon Flex delivery partners for a certain time period (the “Referral Period”) specified in the email inviting the Referrer to participate in the Programme. Eligible Amazon Flex delivery partners will not be able to refer after the Referral Period is closed. The Programme is offered at Amazon’s discretion from time to time and may not be offered at all times.If the Programme is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Amazon including but not limited to technical difficulties, unauthorised intervention or fraud, Amazon expressly reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Referrer or Referee from the Programme; or (b) to modify, suspend, or terminate (as applicable) the Programme, in whole or in part, acting reasonably.

‍This Programme is limited to Amazon Flex delivery partners in Singapore.

‍Disclaimer

‍The Programme and/or any of its features, including Referral Incentives, may be unavailable, inaccurate, or interrupted from time to time for a variety of reasons outside of our control. To the fullest extent permitted by law, we are not responsible for any unavailability, interruptions, or errors of the Programme, its features, or any Referral Incentives. The Programme and all the information accessible through it are provided for informational purposes only on an “as is” and “as available” basis. Amazon and its affiliated entities and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Programme, the information, materials, content, availability, and products.

‍Limitation of Liability

‍Except as set forth herein or any liability which cannot by law be excluded including the Non-Excludable Liabilities (defined below), all disputes arising out of or relating to these Programme Terms will be governed in accordance with the Amazon Flex Terms. By participating in the Programme or receiving any Referral Incentive, you agree that Amazon, its affiliates and subsidiaries, and its officers, directors, employees, representatives, and agents, including any third party (collectively, the “Released Parties”) are not responsible for and will have no liability or responsibility whatsoever for any liability for any claims, demands, injuries, losses, or damages of any kind (known or unknown, including, without limitation, direct, indirect, incidental, special, consequential, or punitive or exemplary damages) to persons, including personal injury or death, or property arising out of or related to, in whole or in part, directly or indirectly, any action taken or neglected to be taken with regard to the Programme, including but not limited to, use of the Programme and any Referral Incentives which arises in any way out of (a) loss or misdirection of, or delay in receiving, any Referral Incentive; (b) theft or unauthorised use of a Referral Incentive caused by circumstances beyond the reasonable control of Amazon or its representatives or agents; (c) any acts or omissions of third parties; (d) any errors published in relation to the Programme, including, without limitation, any typographical errors, errors of description, and errors in the calculation of completed delivery blocks; or (e) any use of the Referral Incentive. Amazon reserves the right to correct, without notice, any errors. In no event shall the Released Parties be liable to you for any delay in or failure to perform due to causes beyond Amazon’s control, including, without limitation, any act of God, and act of war, natural disaster, terrorism, or any act or omission of a third party. To the fullest extent permitted by law, Amazons liability for a breach of a Non-Excludable Liability is limited, to (at Amazon Flex's option): (a) in the case of goods, the replacement of the goods or the supply of equivalent goods, or (b) in the case of services, the supplying of the services again or the payment of the cost of having the services supplied again.

Nothing in these Program Terms limits, excludes or modifies or purports to limit, exclude or modify consumer protection laws in Singapore ("Non-Excludable Liabilities"). Except for any liability that cannot by law be excluded, including the Non-Excludable Liabilities, Amazon (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Programme.

‍Indemnification

‍You agree to indemnify and hold harmless the Released Parties from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) arising from your or an authorised user’s: use of the Programme, any fraud or misuse of the Programme, or violation of any applicable law or the rights of any third party. An authorised user is anyone who you authorise to use your Flex account (even if such authorisation breaches the Amazon Flex Terms). This Section will survive termination of your participation in the Programme. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Amazon.

‍Other Important Information You Should Know

‍You are solely responsible for any tax implications, including disclosure requirements, related to participating in the Programme and on the Referral Incentives that you receive. Please consult your tax advisor if you have any questions about your personal tax situation.

‍This Programme is void where prohibited by law.

‍This Programme is in no way sponsored, endorsed or administered by, or associated with any social media platform. The social media platforms will not be liable for any loss or damage or personal injury which is suffered or sustained by a Referrer or Referee, as a result of participating in this Programme (including taking/use of the Referral Incentive), except for any liability which cannot be excluded by law.

‍This Programme is governed by the laws of Singapore.

‍Amazon may enforce these Programme Terms at any time. Amazon may also delay enforcement without losing its right to enforce any of the Programme Terms at a later time. If any of the Programme Terms are found to be unenforceable, Amazon may still enforce the other Programme Terms.
